Messaging and SMS Terms

These Messaging and SMS Terms ("Messaging Terms") apply to all email, SMS, text, campaign, reminder, notification, and communication features available through MyChairHQ. They are incorporated into the MyChairHQ Terms of Service.

1. Roles

MyChairHQ provides communication tools and related infrastructure. Professional decides whom to message, what to say, when to message, and whether the message is transactional, marketing, promotional, or otherwise. Professional is responsible for message content, recipient selection, consent, opt-out handling, records, and compliance with communications laws and provider rules.

MyChairHQ may send Platform notices, account notices, billing notices, security notices, and other administrative communications directly for MyChairHQ purposes.

2. Transactional vs. Marketing Messages

Transactional messages include appointment confirmations, reminders, cancellations, rescheduling notices, payment notices, account notices, and other messages related to an existing booking, account, or transaction.

Marketing messages include promotions, discounts, win-back campaigns, review campaigns with promotional content, newsletters, product sales, advertising, and other messages encouraging a purchase or commercial action beyond a current transaction.

Professional must correctly classify messages and comply with the stricter rules when a message contains both transactional and marketing content.

3. SMS Consent Requirements

Before sending SMS through the Platform, Professional must obtain and maintain legally sufficient consent from each recipient. Consent must be clear, voluntary, and tied to the type of messages sent.

For appointment reminders and other transactional texts, Professional must provide clear notice that SMS may be sent, disclose that message and data rates may apply, disclose that message frequency varies, and provide STOP/HELP instructions where required.

For marketing or promotional texts, Professional must obtain express written consent where required. Consent cannot be a condition of booking or purchasing services unless allowed by law. Professional must keep records showing when, how, where, and for what type of messages the recipient opted in.

Professional may not import, upload, or message phone numbers collected from purchased, rented, scraped, shared, or third-party lists unless Professional has lawful consent for the specific messages.

4. SMS Opt-Outs and Help

Professional must honor opt-outs and revocations of consent. MyChairHQ may process standard keywords such as STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, and similar opt-out requests where supported. MyChairHQ may also process HELP requests where supported.

Professional must not manually re-subscribe a Customer who opted out unless the Customer provides renewed consent. Professional must treat reasonable opt-out requests made through other channels as revocations when legally required.

Stopping SMS reminders does not automatically cancel an appointment. Professional remains responsible for appointment-management and Customer communications.

5. Email Marketing Requirements

Professional marketing emails must:

  1. use accurate sender, header, and routing information;
  2. use non-deceptive subject lines;
  3. identify the message as an advertisement where required;
  4. include Professional's valid physical postal address where required;
  5. include a clear and functioning unsubscribe mechanism;
  6. honor email opt-outs within the legally required time;
  7. avoid purchased, harvested, or scraped lists; and
  8. comply with CAN-SPAM and other applicable email laws.

Professional must not use MyChairHQ email tools to send spam, deceptive campaigns, harassment, illegal content, or high-risk content.

6. A2P 10DLC, Carrier, and Provider Rules

Professional must provide accurate brand, campaign, opt-in, opt-out, HELP, sample-message, business, and use-case information required for SMS registration, carrier compliance, provider approval, or A2P 10DLC registration. Professional must not send messages inconsistent with the registered campaign or approved use case.

Carriers, messaging providers, and MyChairHQ may filter, block, throttle, reject, suspend, or terminate messaging. MyChairHQ does not guarantee message deliverability, timing, throughput, or carrier acceptance.

7. Required Message Disclosures

Where applicable, Professional must display and maintain disclosures such as:

Appointment reminders: "I agree to receive appointment confirmations and reminders by email and/or text message related to my booking. Message and data rates may apply. Message frequency varies. Reply STOP to stop SMS reminders and HELP for help."

Marketing SMS: "I agree to receive promotional text messages from [Professional Business Name] at the phone number provided. Consent is not required to book or buy services. Message and data rates may apply. Message frequency varies. Reply STOP to cancel and HELP for help."

Professional must adapt disclosures to its actual practices and message types.

8. Prohibited Messaging

Professional may not send messages that:

  1. lack required consent;
  2. lack required opt-out instructions;
  3. contain false, deceptive, misleading, illegal, discriminatory, harassing, threatening, or abusive content;
  4. promote prohibited services under the Acceptable Use Policy;
  5. contain regulated health, financial, alcohol, tobacco, cannabis, gambling, political, adult, or other restricted content unless expressly permitted and lawful;
  6. violate provider, carrier, A2P, campaign, or platform rules;
  7. create high spam complaints, carrier blocks, unsubscribe spikes, bounce rates, or unreasonable provider costs; or
  8. evade filtering, identity, rate limits, or enforcement.

9. Records and Audit Rights

Professional must maintain records of SMS and email consent, including source, timestamp, language shown, phone number or email address, IP address or form source if available, message type, and opt-out history. Professional must provide records to MyChairHQ upon request for compliance, provider, carrier, legal, or dispute purposes.

10. Suspension and Enforcement

MyChairHQ may suspend or disable messaging features, cancel campaigns, block recipients, throttle sending, require re-verification, require consent proof, or terminate accounts if MyChairHQ believes messaging violates these Messaging Terms, laws, provider rules, carrier rules, or creates risk.

11. Costs and Credits

Professional is responsible for SMS credits, message fees, add-on fees, overage fees, provider fees, failed-message costs where charged, campaign-registration fees, and related costs. SMS credits are non-refundable and may expire or be limited as described at purchase or in the Payment Terms.

12. Indemnity

Professional will defend, indemnify, and hold harmless MyChairHQ from claims, investigations, fines, penalties, carrier fees, provider fees, losses, costs, damages, and attorneys' fees arising from Professional messages, message content, consent failures, opt-out failures, imported contacts, campaign registration, TCPA, CAN-SPAM, A2P, carrier rules, provider rules, or other communications-law violations.
